Non-admission of revision for insufficient demonstration of decision-relevance regarding extraterritorial application of EU Regulation No. 715/2007
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) dismissed the plaintiff's non-admission complaint, upholding the appellate court's decision to deny leave to appeal for lack of fundamental legal significance. The dispute concerned the interpretation of the extraterritorial scope and conditions for consumer guarantees under EU Regulation No. 715/2007, specifically Article 3(1) No. 10. The court held that the plaintiff failed to sufficiently demonstrate the decision-relevance of the raised legal questions regarding the admissibility of a revision under §§ 543 and 544 of the Code of Civil Procedure (ZPO). Consequently, the appellate decision remains in force, the plaintiff bears the costs of the complaint proceedings, and the subject matter value was set at up to €30,000.
