Insolvency suspension does not bar dismissal of premature non-appeal complaint
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiff’s non-appeal complaint, upholding the lower court’s decision to deny leave for appeal and assigning the costs to the plaintiff. The dispute concerned a civil claim where the plaintiff filed a complaint challenging the district court’s refusal to admit a revision appeal; the court had to determine whether the opening of insolvency proceedings over the plaintiff’s estate, which suspended the proceedings, prevented the procedural rejection of an appeal that was already inadmissible at the time of filing. The court ordered the dismissal of the complaint on the grounds that it was not filed within the one-month statutory deadline by a lawyer admitted to the appellate court, a defect that existed prior to the procedural suspension. Relying on §§ 544, 78, and 97 ZPO, the court held that pursuant to § 249 para. 3 ZPO, a legal remedy that was inadmissible before the suspension remains subject to dismissal during the suspension, meaning the insolvency-related suspension did not bar the procedural rejection.
