Anwaltszwang in the Insolvency Rechtsbeschwerde: Inadmissibility of the Appeal due to Lack of Representation by a BGH-Admitted Attorney
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the appeal for revision (Rechtsbeschwerde) as inadmissible and ordered the costs to be borne by the opposing parties. The dispute concerned the challenge to the insolvency court’s determination of the compensation for members of the creditors’ committee, with the appellant arguing that the mandatory representation by a BGH-authorized attorney should not apply by analogy to this specific type of insolvency proceeding. The court held that the requirement for mandatory legal representation by an attorney admitted to the BGH is clearly established by §§ 4, 6, 7, 64(3) sentence 1, and 73(2) InsO in conjunction with § 78(1) sentence 3 ZPO, and that filing the appeal via a declaration to the record is prohibited for appeals for revision under § 575(1) sentence 1 ZPO, rendering the exception in § 78(3) ZPO inapplicable.
