The Federal Court of Justice (BGH) dismissed the plaintiff's application for reinstatement and its complaint against the non-admission of a revision appeal, upholding the lower court's refusal to admit the appeal to the federal level. The dispute concerned a patent infringement claim where the plaintiff challenged the Oberlandesgericht Düsseldorf's decision not to allow a further appeal, arguing issues of fundamental significance and procedural rights. The BGH ruled that the case did not meet the requirements for revision under Section 543(2) of the Code of Civil Procedure because the interpretation of the contested patent was consistent with the court's prior ruling in a related nullity proceeding, thereby establishing that the matter lacked fundamental legal significance and did not require further legal development or the assurance of uniform jurisprudence. The plaintiff was ordered to bear the costs of the proceedings, and the value in dispute was fixed at 1 million euros.

Insbesondere steht die Auslegung des Klagepatents in der angefochtenen Entscheidung in Einklang mit der Auslegung in dem Berufungsurteil des Senats im Nichtigkeitsverfahren (BGH, Urteil vom 27. September 2022 - X ZR 87/20, GRUR 2022, 1731 Rn. 21 ff., insbes. Rn. 31 - Brenngutkühlung).
