Sentencing range limits and blocking effect of aggravating statutes in sexual assault cases
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Criminal Revision dismissed the defendant’s appeal as unfounded, thereby upholding the Landgericht Marburg’s judgment of November 15, 2023, which convicted the defendant and ordered him to bear the costs of the appeal proceedings. The legal dispute centered on the adequacy of the sentencing rationale for a sexual assault charge, specifically whether the trial court erred in stating that the imposed penalty "clearly exceeded the lower limit of the statutory range but did not yet reach the middle area." In a supplementary remark, the Court clarified that the trial court likely attributed the sentencing position solely to the blocking effect ("Sperrwirkung") of the lower limit of § 177(6) sentence 1 StGB (serious sexual assault) vis-à-vis the mitigating sentencing range of § 177(8) StGB under § 177(9) sentence 1, variant 3, StGB. The appellate court held that this interpretation did not disadvantage the defendant, leaving open whether the upper limit of § 177(6) sentence 1 StGB also exerts a blocking effect, while noting academic opinion that such a mechanism would discourage qualifying the offense with additional aggravating elements.

Aufl., § 177 Rn. 212).
