Admissibility of non-admission complaint requiring fundamental legal significance or unified jurisprudence in civil matters
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the plaintiff's non-admission complaint, thereby upholding the prior appellate court's decision and leaving the underlying judgment in force, with the plaintiff ordered to bear the procedural costs. The dispute concerned a civil matter where the plaintiff challenged the higher regional court's refusal to grant leave for appeal, arguing that the case involved issues of fundamental legal significance or a need to unify case law. The BGH held that the legal question lacked general significance and did not require further development of the law or assurance of uniform jurisprudence for the purposes of a final review, relying on its prior ruling in a comparable case to justify the rejection of the complaint.
