Legislator-Zusammenfassung

KI-generiert

The Federal Court of Justice (BGH) 5th Criminal Senate dismissed the defendant's revision, upholding the Landgericht Berlin's conviction and ordering the defendant to bear the costs of the appeal and the necessary expenses of the complainant. The dispute centered on whether the exclusion of the public during the reading of a memorandum protocol and part of the complainant's police interrogation in a criminal trial violated the principle of publicity under § 338 Nr. 6 StPO. The court held that the exclusion was legally valid because it was sufficiently justified under § 171b Abs. 1 and 3 GVG for the complainant's testimony; this exclusion inherently encompassed the closely related readings of the memorandum protocol pursuant to § 249 Abs. 1 StPO and the police interrogation under § 253 Abs. 1 StPO, thereby eliminating the need for a separate public deliberation and announcement of the exclusion for those specific readings.
