Inadmissibility of legal appeal against unappealable refusal of permission to appeal
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the debtor's filing, characterized as a legal appeal (*Rechtsbeschwerde*), as inadmissible and placed the costs on the appellant, thereby leaving the prior lower court ruling in force. The dispute concerned an appeal against a decision by the Landgericht Ansbach, where the appellate court had not granted permission for the legal appeal. The decisive legal basis was § 574(1) No. 2 and § 577(1) sentence 2 of the Code of Civil Procedure (ZPO), which render the decision on the denial of admission non-appealable; consequently, no avenue for extraordinary legal review existed, and constitutional law did not require one.
