Correction of criminal association charge to foreign association participation in Hawala banking case
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the defendant's appeal as unfounded, upholding the conviction but modifying the operative part of the judgment to reflect the correct legal classification of the crime; consequently, the defendant is found guilty of "participation in a foreign criminal association" rather than "membership in a criminal association." The case involved a defendant who was convicted by the Landgericht Düsseldorf for joining a Hawala-Banking network identified as a criminal association. The BGH determined that while the lower court correctly established liability under §§ 129, 129b StGB, the judgment's formulation failed to explicitly state that the association was a foreign one, a detail deemed necessary for the legal characterization. Based on § 354 Abs. 1 StPO applied analogously, the BGH ordered the amendment of the guilt statement to accurately reflect the extraterritorial nature of the criminal association, with costs of the appeal borne by the defendant.
