Constitutional right to be heard regarding refusal to extend deadline for responding to preliminary court notice
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) rejected the defendant's complaint against the refusal to admit an appeal to the BGH, thereby confirming the appellate court's earlier decision that stands in force. The dispute concerned a procedural matter in a civil case where the defendant sought an extension of the deadline to respond to a preliminary ruling, which the appellate court denied, finding no significant reasons to justify further delay under § 224 Abs. 2 ZPO. The BGH held that this refusal did not violate the constitutional rights to legal hearing (§ 103 GG) or a fair procedure, as it did not require notification of the refusal before the deadline expired to allow for a post-deadline response. The defendant is ordered to bear the costs of the complaint proceedings, and the subject matter amount is set at up to €230,000.

Halbsatz ZPO).
Die Beklagte trägt die Kosten des Beschwerdeverfahrens (§ 97 Abs. 1 ZPO).
