Inadmissibility of Rechtsbeschwerde against legal aid refusal due to statutory prohibition on appeal in Prozesskostenhilfe proceedings
Legislator-Zusammenfassung
KI-generiertThe Bundesgerichtshof (BGH) 9th Civil Senate dismissed the plaintiffs' application for legal aid and the appointment of a counsel for the appeal (Rechtsbeschwerde) proceedings, ruling in favor of the defendant regarding the procedural threshold. The dispute concerned a challenge to an order by the Karlsruhe Higher Regional Court concerning legal aid, where the plaintiffs sought to appeal that decision to the BGH. The court held that the intended appeal was inadmissible because German procedural law does not generally permit Rechtsbeschwerde in legal aid proceedings, and the lower court did not specifically admit it; consequently, such non-admission is neither subject to a special complaint nor a constitutional requirement, rendering the prospects of success insufficient under § 114 Abs. 1 Satz 1 ZPO and the appointment of a lawyer under § 78b Abs. 1 ZPO.

[GRUENDE]
