Invalidity of self-standing confiscation in protective proceedings due to lack of separate application under § 440 StPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (5th Criminal Senate) dismissed the defendant’s revision as unfounded but ordered the removal of the confiscation decision from the judgment, ruling in favor of the defendant on this specific procedural point while the remainder of the underlying criminal judgment remains in force. The case involved a challenge to the validity of a self-standing confiscation order issued during a protective proceedings (Sicherungsverfahren) pursuant to § 413 StPO. The Court held that such confiscation is procedurally invalid because the statutory prerequisites for self-standing confiscation under § 76a(2) sentence 1 no. 2 in conjunction with § 74(2) no. 2 and (3) StGB can only be realized through a separate confiscation proceeding under § 440(1) StPO, requiring a distinct application which was not filed; consequently, the lack of a procedural prerequisite rendered the original order void.

Sicherungsverfahren: Wirksamkeit einer Einziehungsanordnung
[TENOR]
