Inadmissibility of legal complaint against appellate order without express admission
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the applicant’s request for legal aid and the appointment of a compulsory attorney for a legal complaint, rejecting the applicant's challenge. The dispute concerned an interlocutory order issued by an appellate civil court, and the applicant sought to appeal this decision to the highest court. The decisive legal basis was the procedural inadmissibility of the legal complaint, as the law did not expressly permit such an appeal against the specific type of order, the lower court had not admitted the appeal, and no provision exists to challenge the non-admission of a legal complaint, rendering further ordinary or constitutional recourse unavailable under the relevant provisions of the Code of Civil Procedure.

BGH, Beschluss vom 7. März 2002 - IX ZB 11/02, BGHZ 150, 133 ff) und verfassungsrechtlich auch nicht geboten (BVerfGE 107, 395 ff).
