Denial of legal aid for Rechtsbeschwerde against non-appealable civil order due to lack of statutory admissibility
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) denied the applicant's request for legal aid and appointment of counsel for a legal complaint (Rechtsbeschwerde), upholding the appellate court's earlier order. The dispute concerned an application for process costs assistance in an appeal against a decision by the Oberlandesgericht Stuttgart in a civil matter. The application was rejected because the intended legal complaint lacked a sufficient prospect of success and was procedurally inadmissible; the law does not expressly permit a legal complaint against such orders, nor did the lower court admit one, and no extraordinary complaint or constitutional remedy is available for the non-admission of a legal complaint. The decisive legal basis includes §§ 78b(1), 114(1) sentence 1 ZPO for the denial of legal aid due to lack of success prospects, and § 574(1) sentence 1 ZPO in conjunction with § 577(1) sentence 2 ZPO, which establish the unavailability of the Rechtsbeschwerde as a remedy in this procedural context.

Volltext
BGH, Beschluss vom 7. März 2002 - IX ZB 11/02, BGHZ 150, 133 ff) und verfassungsrechtlich auch nicht geboten (BVerfGE 107, 395 ff).
