Insurance Bona Fides Defense: No CJEU Reference Required; Admissibility of Revision
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Civil Procedure (BGH) 4th Civil Senate dismissed the plaintiff's complaint against the non-admission of revision, leaving the Munich Higher Regional Court's decision in force; the plaintiff bears the costs of the appeal proceedings. The dispute concerned insurance law, specifically challenges regarding the EU Directive conformity of the insurance policy model and the defense of bona fides, where the plaintiff sought to justify the admission of revision through fundamental significance or the need for uniform jurisprudence. The court held that the EU Directive conformity was not decisive for the outcome in this specific instance and that a preliminary reference to the Court of Justice of the European Union regarding the bona fides defense was unnecessary, relying on prior BGH jurisprudence that established the sufficiency of national legal standards on this issue.
