Admissibility of revision appeal in insurance dispute: EU directive conformity and good faith doctrine not decisive
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) rejected the plaintiff's complaint against the non-acceptance of leave to appeal, thereby upholding the appellate court's decision and leaving the respondent in the prevailing position. The dispute arose in a civil procedure concerning insurance law, specifically challenging the decision to deny revision based on claims of lack of fundamental legal significance or the need for legal unification. The court determined that the issue of the insurance policy model's conformity with EU directives was not decisive for the outcome of the case and ruled that a preliminary reference to the Court of Justice of the European Union was unnecessary regarding the argument of good faith (Treu und Glauben), relying on established case law. Consequently, the plaintiff was ordered to bear the costs of the complaint proceedings, with the amount in dispute set at no more than €65,000.
