Consumer withdrawal right expired before revocation declaration: dismissal of non-admission complaint
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Civil Procedure (BGH) dismissed the plaintiff’s complaint against the non-acceptance of leave to appeal, thereby confirming the lower court’s ruling and leaving the original judgment in force; the plaintiff, who had attempted to exercise a right of withdrawal for a consumer contract, was held to have lost this right because the statutory withdrawal period had expired prior to the declaration. The dispute centered on the temporal validity of a consumer’s withdrawal right, with the decisive legal basis being the expiration of the withdrawal deadline as interpreted in accordance with the principles established in the court's earlier jurisprudence on consumer protection law, specifically relying on the reasoning provided in the cited 2024 judgment.
