Apartment Owners' Association litigation: Admissibility of non-admission appeal and ex officio amendment of value in dispute
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (5th Civil Senate) dismissed the plaintiff's appeal on non-admission, thereby upholding the lower court's decision and leaving the prior judgment in force; the plaintiff was ordered to bear the costs of the appeal proceedings, with a value in dispute set at €25,507.82. The dispute concerned a decision issued in an apartment owners' association matter, where the plaintiff challenged the admissibility of the lower court's ruling. The court held that the case raised no questions of fundamental significance and did not require a decision for the purpose of developing the law or ensuring uniform jurisprudence pursuant to § 543 Abs. 2 ZPO, and it clarified that the Senate lacks authority to amend the value in dispute for the previous instances ex officio under § 63 Abs. 3 Satz 1 Nr. 2 GKG because filing a non-admission appeal does not lead to the accrual of the principal proceedings.

Senat, Beschluss vom 26. Januar 2023 - V ZR 40/22, juris Rn. 6).
