Inadmissibility of revision challenging EncroChat evidence due to failure to specify participation in trial objection under § 344 Abs. 2 StPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (5th Criminal Senate) dismissed the appeals of two defendants against a judgment by the Regional Court of Bremen, leaving the original conviction in force and ordering each appellant to bear the costs of their respective appeals. The defendants had challenged the validity of the proceedings and the admissibility of evidence derived from the EncroChat communication service; specifically, one defendant argued that the data should not have been used due to lack of consent or improper handling, while the other’s appeal was deemed procedurally defective for failing to specify whether it had joined an earlier objection to the data’s use raised by a co-defendant’s counsel during the trial. The court found the appeal inadmissible and unfounded, applying § 344 para. 2 sentence 2 of the Code of Criminal Procedure, which requires appellants to clearly articulate the specific procedural errors and their connection to the facts as established in the trial record, including the status of any prior objections or court orders regarding the exclusion of evidence.
