Discontinuation of a minor drug-trafficking count and reduction of aiding-and-abetting conviction to five cases
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) granted a partial success to the defendant's revision, ordering the proceedings in one of six counts to be discontinued pursuant to § 154 StPO, and amending the guilty verdict to reflect the remaining five cases of aiding and abetting drug trafficking in significant quantities, while rejecting the further appeal. The Landgericht Nürnberg-Fürth had initially sentenced the defendant to a total imprisonment of four years for aiding and abetting drug trafficking in six instances; the dispute centered on whether one specific count was sufficiently serious or warrantful of continued prosecution given the overall circumstances. The court's decision rests on the procedural authority of § 349 StPO for partial revision success, § 154 Abs. 2 StPO for the discontinuation of the minor charge, and § 354 Abs. 1 StPO for the consequential amendment to the declaratory judgment, noting that the dismissal of one count did not necessitate a change to the aggregate sentence due to the remaining concurrent offenses.

[GRUENDE]
