Admissibility of procedural challenge to EncroChat data valuation for failure to specify self-reading and transfer protocols.
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Criminal Justice (BGH) dismissed the defendant's appeal as unfounded, upholding the conviction and sentencing imposed by the lower court and ordering the defendant to bear the costs of the appellate proceedings. The dispute centered on a criminal prosecution in which the defendant challenged the admissibility and use of data obtained from the EncroChat platform. The court determined that the appeal was procedurally inadmissible regarding this specific evidentiary challenge because the defendant failed to disclose essential documents, including self-reading orders and protocols concerning the transfer and processing of the EncroChat data by German investigative authorities, as required for a viable procedural complaint. Consequently, the procedural objection under Section 344 Paragraph 2 Sentence 2 of the Code of Criminal Procedure (StPO) was rejected for non-compliance with the requirements established in Section 347 Paragraph 1 Sentence 3 StPO.
