Online retailer compliance with product information obligations: requirement of temporal and spatial-functional connection between mandatory disclosures and order button
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the defendant’s complaint, upholding the Munich Higher Regional Court’s refusal to admit an appeal to revision and ordering the defendant to bear the costs of the proceedings. The dispute concerned a competition law violation by an online retailer, specifically whether the provider’s website complied with statutory requirements for displaying mandatory information about essential product characteristics immediately prior to the order button. The court determined that the defendant’s design, which linked to product details only within the shopping cart, definitively failed to meet the legal standard because it lacked the requisite temporal and spatial-functional connection between the mandatory disclosures and the order button. Relying on § 543 Abs. 2 ZPO, the court concluded that no reference to the Court of Justice of the European Union was necessary as the non-compliance was clear, and the issue of whether such links could satisfy requirements on the order button page was deemed unnecessary to decide.
