Reimbursement of court-appointed co-accuser's travel costs for revision hearing despite lack of independent right to appeal preventive detention
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Criminal Justice (BGH) ordered that the travel expenses for the court-appointed lawyer representing the victim’s co-accuser to the main hearing on July 4, 2024, are necessary and therefore reimbursable under official fee regulations. The dispute concerned a request for reimbursement of travel costs incurred in connection with an appeal by the public prosecutor challenging the lower court’s decision not to order preventive detention against the defendant. The court held that the co-accuser’s right to participate in proceedings, including the right to be represented by counsel, persists even when the co-accuser lacks standing to individually challenge the non-imposition of preventive detention, provided that the prosecutor’s appeal is admissible, thus rendering the travel essential for the safeguarding of the co-accuser’s interests. The decisive legal basis comprises § 397a StPO for the appointment of counsel, § 46(2) Sentence 1 RVG for the fee and expense reimbursement framework, and § 397 StPO regarding the co-accuser’s procedural rights, confirming that admissible appeals by the prosecution maintain the co-accuser’s procedural position.
