Inadmissibility of criminal evidence motion for lacking sufficient factual specificity under § 244 Abs. 3 StPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) 1st Criminal Senate dismissed the defendant's revision as unfounded, thereby upholding the Stuttgart Regional Court's judgment of July 27, 2023, and ordered the defendant to bear the costs of the appeal and the necessary expenses of the joint plaintiffs. The dispute centered on a criminal prosecution where the defendant challenged the first instance court's refusal to admit a motion for evidence requesting the testimony of a specific witness, arguing that a purely friendly, non-sexual relationship between the defendant and a co-defendant existed. The court held that the challenge failed because the evidence motion was procedurally defective under § 244 Abs. 3 Satz 1 StPO, as it merely asserted a broad evidentiary goal rather than identifying sufficiently concrete, verifiable, and temporally bounded factual claims required to prove the alleged non-sexual nature of the relationship.
