Nichtzulassungsbeschwerde in loan dispute: admissibility denied for failing the statutory dispute value threshold of €20,000 (§ 544 Abs. 2 Nr. 1 ZPO)
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) rejected the plaintiff's complaint against the non-admission of revision, ordering the complaint be dismissed as inadmissible at the plaintiff's expense, thereby leaving the appellate court's judgment in force. The dispute concerned a consumer loan where the plaintiff sought a declaration that the defendant had no remaining claim to contractual interest or standard repayment following a withdrawal notice, and asserted a declaration of acceptance default along with pre-trial attorney's fees. The decisive legal basis was the statutory threshold for non-admission complaints under § 544 Abs. 2 Nr. 1 ZPO, which requires the matter to have a value in dispute exceeding €20,000; the court determined the dispute value was calculated solely on the net loan amount (€15,394.55), excluding the declaration of acceptance default as lacking independent economic value and the attorney's fees as ancillary claims excluded under § 4 Abs. 1 Halbs. 2 ZPO.

Streitwert: 15.394,55 €.
