Inadmissibility of legal appeal against non-admission of Rechtsbeschwerde in legal aid proceedings
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) rejected the applicant's motion for legal aid to file a legal appeal (Rechtsbeschwerde) against a decision by the Saarländisches Oberlandesgericht, leaving the lower court's ruling in force. The dispute concerned a legal aid proceeding where the applicant challenged the refusal of legal aid for the initial appeal, but the legal basis for the challenge was procedurally flawed as the applicant attempted to contest the lower court's non-admission of a legal appeal within legal aid matters. The court held that legal aid was denied because the intended litigation lacked a sufficient prospect of success under § 114 Abs. 1 Satz 1 ZPO, as German law does not provide for a legal appeal in legal aid proceedings (§ 574 Abs. 1 Satz 1 Nr. 1 ZPO) unless specifically admitted by the lower court, which was not the case here; consequently, no further judicial review or extraordinary complaint is available against the non-admission decision.
