Statutory minimum sentencing barriers in drug offenses: legislative rather than substantive concurrence under BtMG
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (5th Criminal Senate) dismissed the defendant's appeal as unfounded, upholding the lower court's judgment and ordering the defendant to bear the costs of the legal remedy. The case involved a challenge to sentencing in a drug trafficking prosecution under the German Narcotics Act (BtMG), specifically concerning the application of statutory minimum sentencing thresholds for offenses adjudicated under § 30a para. 3. The Court determined that while the Regional Court correctly applied the minimum sentencing barriers resulting from the qualitative enhancements under §§ 29a and 30 BtMG, its legal reasoning erroneously relied on the prohibition against double jeopardy for the same act under § 52 para. 2 StGB. Instead, the Court clarified that the applicable legal basis for the exclusion of lesser offenses is the doctrine of legislative concurrence (Gesetzeskonkurrenz), as the relevant provisions constitute a relationship between a qualified offense and its basic constituent offense.

BGH, Urteil vom 13. Februar 2003 – 3 StR 349/02, NJW 2003, 1679).
