Admissibility of hearing objection to dismissal of non-admission complaint and refusal of ex officio counsel due to mandatory legal representation
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiff’s objection to a hearing refusal as unfounded regarding the denial of an appointed lawyer, and rejected it as inadmissible regarding the dismissal of the non-admission complaint, thereby upholding the prior decision and leaving the plaintiff without appointed counsel and with his appeal dismissed for non-compliance with procedural requirements. The dispute concerned the procedural validity of the plaintiff’s attempts to challenge the lower court’s refusal to appoint a "Notanwalt" and the dismissal of his appeal for lack of timely legal representation. The decisive legal bases were Article 103(1) of the German Basic Law regarding the right to be heard, which the court found not violated as the court had considered all arguments, and the mandatory requirement for legal representation ("Anwaltzwang") before the Federal Court of Justice, which applied to the non-admission complaint and its reasoning but not to the initial request for appointed counsel, rendering the objection to the latter’s dismissal procedurally invalid.
