Aggravated bodily injury with a paintball weapon: rejection of "treacherous surprise attack" and "joint commission" aggravations under § 224 StGB
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the appeals of the defendants, thereby upholding the lower court’s conviction and sentencing. The case involved a challenge to a criminal judgment for aggravated bodily injury, where the defendants contested the appellate court’s findings regarding specific aggravating circumstances. The appellate court clarified that the trial court’s factual findings did not support the legal classifications of a "treacherous surprise attack" or "joint commission" as aggravating factors. However, the conviction for aggravated bodily injury using a dangerous instrument (specifically a paintball weapon) was affirmed because the use of such a weapon independently satisfied the statutory requirement for aggravation, and the trial court had not improperly included the unsupported aggravating elements in its sentencing calculation.
