Tort claim under § 823 Abs. 2 BGB based on EU food safety regulations: absence of fault as decisive defense
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the plaintiff's non-allowance complaint, upholding the appellate court's decision and leaving the defendant's success in the prior instances intact. The dispute concerned a claim for damages under tort law, specifically challenging whether the defendant acted with fault in violation of EU food safety regulations. The decisive legal basis was § 823 Abs. 2 BGB in conjunction with § 6 Abs. 1, § 27 Abs. 1 EG-FGV and applicable Union law, where the court confirmed that the lack of proof regarding the defendant's fault justified rejecting the claim and that the case did not involve a matter of fundamental significance or require the unification of jurisprudence.
