Preclusion of lay-judge substitution objection for failure to raise contemporaneous procedural objections and submit requisite court orders
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) rejected the defendant's appeal as unfounded, upholding the conviction by the Regional Court of Lübeck and ordering the defendant to bear the costs of the legal remedy. The case involved a criminal proceeding where the defendant challenged the lower court's verdict and raised a procedural objection (Besetzungsrüge) regarding the composition of the trial court, specifically the substitution of a lay judge. The court determined that the procedural objection was precluded under §§ 222a, 222b, and 344 of the Code of Criminal Procedure (StPO) because the defense counsel failed to file a motion for adjournment or a formal objection during the trial when the changed composition was announced, and the appellant failed to submit the required administrative ruling concerning the fine imposed on the original lay judge, thereby preventing the court from assessing whether the substitution was justified.
