Evidentiary validity of non-compliant DNA analysis reports when conviction rests primarily on defendant’s admission
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) rejected the defendants' appeals as unfounded and dismissed an application for reinstatement of deadlines, resulting in the affirmation of the lower court's conviction and the imposition of procedural costs on the appellants. The case involved a criminal proceeding in which the prosecution appealed for insufficient reasoning regarding DNA analysis of a seized knife, while the defendants challenged the first-instance verdict; the BGH clarified that although the prosecution's brief did not meet strict requirements for describing the type of trace and biostatistical probability, the conviction remained valid because the trial court's identification of the weapon relied principally on the defendants' own admissions rather than solely on the deficiently presented forensic evidence. The decision establishes that the formal inadequacy of a DNA report's description does not automatically render the evidence valueless or void the judgment if other corroborating evidence supports the factual findings.

[GRUENDE]
Februar 2022 – 6 StR 597/21).
