Failure to warn on changed legal characterization of robbery and inadequacy of procedural objection under § 344 Abs. 2 StPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the defendant’s appeal as unfounded, leaving the Landgericht Mönchengladbach’s conviction from August 22, 2023, in force and ordering the appellant to bear the costs of the legal remedy. The dispute concerned a procedural challenge to the trial court’s reclassification of an act originally charged as theft with a weapon into aggravated robbery, with the defendant alleging a violation of his right to be warned about the change in legal perspective prior to verdict. The decisive legal basis was § 344 Abs. 2 Satz 2 StPO, under which the BGH found the procedural objection inadquate because the appellant failed to address the trial court’s earlier judicial warning regarding the potential application of aggravated robbery statutes during the opening hearing, rendering the claimed breach of § 265 Abs. 1 StPO unsubstantiated.

Volltext
