Confiscation of land charge and registered book position; transfer to victim via state
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (Ist Senate) dismissed the defendant's appeal, upholding the Landgericht Traunstein's judgment of 2 March 2021. The case involved a challenge to the lower court's sentencing and an order for the confiscation of a land charge (Grundschuld). The appellate court found no material legal error regarding the concurrence of offenses or the scope of culpability assessed for specific counts, and it declined to amend the confiscation ruling to impose joint and several liability, citing the prohibition against reformatio in peius under § 358 (2) of the Code of Criminal Procedure. The court clarified that the confiscation of the land charge under § 75 (1) sentence 1 number 1 of the Criminal Code includes the associated registered book position, which vests in the State upon the judgment becoming final; the State must then transfer this right to the victim if the victim exercises a claim for restitution, pursuant to § 459j (2) sentence 1 of the Code of Criminal Procedure and § 1196 of the Civil Code.

Einziehungsentscheidung: Einziehung einer Grundschuld
[TENOR]
