Non-admission complaint rejected for lack of fundamental legal significance in civil dispute
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Civil Procedure (BGH) dismissed the plaintiff's non-admission complaint, ruling that the dispute lacked fundamental legal significance and did not require a higher court decision for the development of law or uniform jurisprudence; consequently, the lower appellate court's decision of August 2, 2021, remains in force, and the plaintiffs were ordered to bear the costs of the appeal. The case involved a civil dispute where the plaintiffs attempted to have the Revisionsgericht hear the matter, but the court found no substantial legal issues warranting review, relying on a previous ruling from February 8, 2022, for its justification. The decision was grounded in § 543 Abs. 2 Satz 1 ZPO regarding the lack of fundamental significance and § 544 Abs. 6 Satz 2 Halbs. 2 ZPO, which allowed the court to omit a detailed written justification, with the costs imposed under § 97 Abs. 1 ZPO.
