Effectiveness of consumer loan revocation instructions and withdrawal period calculation
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) dismissed the plaintiff's complaint against the non-admission of an appeal on revision, thereby leaving the decision of the Higher Regional Court in force, with the plaintiff bearing the costs of the proceedings. The dispute concerned a consumer loan agreement where the validity of the revocation instruction (right of withdrawal) and the calculation of the withdrawal period were challenged. The BGH held that the legal issues did not possess fundamental significance and did not require a decision by the revision court to foster legal development or ensure uniform jurisprudence, pursuant to § 543 Abs. 2 Satz 1 ZPO, and omitted a detailed written reasoning in accordance with § 544 Abs. 4 Satz 2 ZPO.
