Admissibility of non-allowance complaint requiring admission to the Federal Court of Justice
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiff's appeal as inadmissible, rejecting his application for legal aid and declaring his "petition for clemency" impermissible, thereby leaving the lower court's denial of leave to appeal in force. The dispute concerned a civil matter where the plaintiff, acting without a lawyer admitted to the Federal Court of Justice, challenged the Superior Court of Karlsruhe's refusal to grant leave for revision, resulting in the proceedings being terminated at the appellate level. The decision rested on § 78 Abs. 1 Satz 3 ZPO regarding the mandatory representation by a counsel admitted to the supreme court, § 114 Abs. 1 Satz 1 ZPO denying legal aid due to insufficient prospect of success, and § 544 Abs. 3 Satz 1 ZPO, which establishes that no further legal remedy exists beyond the non-appealability complaint and the complaint must be filed within the statutory deadline.

Die mit Schreiben vom 25. Juni 2023, 12.
