Admissibility of revision: substantiation of unauthorized shutdown device and procedural fundamental rights in civil appeal
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Civil Procedure (BGH) dismissed the plaintiff's complaint for non-admission of revision, rejecting the appeal against the decision of the Oberlandesgericht Hamm; consequently, the lower court's judgment remains in force, and the plaintiff is ordered to bear the costs of the proceedings. The dispute involved a civil action where the appellate court ruled that the plaintiff had failed to sufficiently substantiate the use of an unauthorized shutdown device. The BGH determined that the case lacked fundamental legal significance and that the alleged violations of procedural fundamental rights were not compelling, denying the request for a further instance under § 543 Abs. 2 Satz 1 ZPO and noting that a detailed justification was unnecessary under § 544 Abs. 6 Satz 2 ZPO.
