The Federal Court of Justice dismissed the plaintiff’s complaint against the non-acceptance of revision, thereby upholding the appellate court’s decision and leaving the lower-instance ruling in force. The dispute, stemming from a liability claim where the appellate court had found the defendant not at fault, involved the plaintiff’s challenge to the Higher Regional Court of Hamm’s refusal to accept the case for revision, asserting a violation of fundamental procedural rights. The court determined that the plaintiff failed to demonstrate that the case possessed fundamental significance or required further development of the law to ensure uniform jurisprudence, and it rejected the alleged procedural rights violations as non-substantive. The decision is grounded in § 543 Abs. 2 Satz 1 ZPO regarding the requirements for accepting revision and Art. 267 AEUV, with the rejection of the complaint based on the lack of identified admission grounds and the application of § 544 Abs. 6 Satz 2 Halbsatz 2 ZPO to dispense with a detailed justification.

Volltext
