Insurance policy model directive conformity and good faith objections; no requirement for CJEU reference or revision admission
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Civil Procedure dismissed the plaintiff's complaint against the non-admission of revision, thereby upholding the appellate court's decision and leaving the prior ruling in force; the plaintiff bears the costs of the complaint proceedings. The dispute involved a challenge to an insurance policy model, specifically concerning arguments of EU directive compliance and good faith, where the plaintiff sought to have the case referred to the Court of Justice of the European Union. The court held that the revision was inadmissible as the matter lacked fundamental significance or need for uniform jurisprudence, noting that the plaintiff's claims regarding the policy model's directive conformity and good faith objections were not dispositive for the outcome, making a preliminary reference to the CJEU unnecessary in accordance with § 543 Abs. 2 ZPO and established case law.
