Non-admission of revision in insurance dispute: no preliminary reference to CJEU required for good faith defense and no fundamental significance
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (4th Civil Senate) dismissed the plaintiff's complaint against the non-admission of a revision appeal, thereby upholding the Stuttgart Higher Regional Court's decision from October 12, 2022. The case concerned an insurance dispute where the plaintiff challenged the admissibility of a revision, arguing that the policy model was non-compliant with EU guidelines and that the defense based on good faith (*Treu und Glauben*) required a preliminary reference to the Court of Justice of the European Union. The Court held that the preliminary reference was not necessary, relying on its earlier precedent (July 19, 2023 - IV ZR 268/21), and determined that the matter lacked fundamental legal significance or a need for uniform case law under § 543 Abs. 2 ZPO; the Court also noted that it had internally assessed and denied the prospects of success for a revision. Consequently, the plaintiff is liable for the costs of the complaint proceedings, with the amount in dispute capped at €30,000.
