Tort liability against engine manufacturer for emissions manipulation and lack of admissibility grounds for revision
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) dismissed the plaintiff's complaint against the non-admission of revision, thereby upholding the prior appellate judgment and leaving the plaintiff to bear the costs of the proceedings. The dispute concerned a civil liability claim arising from alleged emissions manipulation, where the plaintiff sued an engine manufacturer for tortious interference and violation of statutory provisions under the German Food and Feed Law. The court held that the plaintiff failed to demonstrate the requisite legal grounds for admission, specifically the lack of a viable claim under § 826 BGB due to the defendant's status as an engine rather than vehicle manufacturer, and that the alleged violation of procedural fundamental rights did not warrant a re-examination.

2 ZPO abgesehen.
Der Kläger trägt die Kosten des Beschwerdeverfahrens (§ 97 Abs. 1 ZPO).
Der Gegenstandswert des Beschwerdeverfahrens beträgt bis 30.000 €.
