Unlawful shutdown device: failure to substantiate defect and lack of fault preclude admission of revision
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) rejected the plaintiff's complaint against the non-admission of revision, thereby upholding the Dresden Court of Appeal’s judgment and leaving the lower court’s ruling in force against the plaintiff. The dispute concerned a product liability or defective product case involving alleged claims against a defendant for installing an unauthorized or defective shutdown device ("Abschalteinrichtung"). The appellate court had dismissed the plaintiff’s claims on two independent grounds: the plaintiff’s failure to adequately substantiate the existence of an unlawful shutdown device and the defendant's lack of fault. The BGH held that the plaintiff failed to demonstrate fundamental legal significance, the need for legal development, or a requirement to ensure uniform jurisprudence under § 543 Abs. 2 Satz 1 ZPO, and also rejected allegations of violations of procedural fundamental rights, noting that the matter did not contribute to clarifying the prerequisites for admitting revision under § 544 Abs. 6 Satz 2 Halbsatz 2 ZPO.
