Exclusion of consumer credit revocation right following full loan performance under EU Directive 2008/48
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the plaintiff's complaint for non-admission of revision, upholding the lower court's decision and leaving the defendant's position intact. The dispute concerned whether a consumer borrower retained the right to revoke a credit agreement under Article 14(1) of Directive 2008/48/EC after the loan had been fully performed and discharged. Relying on the recent case law of the Court of Justice of the European Union, the court held that the right to withdraw from a consumer credit contract does not survive the complete fulfillment of the loan agreement. Consequently, the plaintiff’s claim based on revocation after full performance was found to lack legal merit, and the court determined that the case did not raise issues of fundamental legal significance requiring a decision by the revising court.
