Reinstatement unavailable for post-deadline substantive supplementation of revision appeal grounds under § 543 ZPO in EU vehicle emissions liability
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) rejected the plaintiff's application for reinstatement of time limits as inadmissible and dismissed the plaintiff's appeal against the non-admission of revision, upholding the lower court's judgment. The dispute concerned a civil liability claim based on § 823 Abs. 2 BGB in conjunction with Regulation (EC) No 715/2007 and Directive 2007/46, where the plaintiff failed to raise a substantive ground for allowing revision within the statutory deadline for the initial statement of grounds. The court held that reinstatement under §§ 233 ff. ZPO is not available for the subsequent substantive supplementation of a timely filed but incomplete appeal brief, and further determined that the case lacked fundamental significance or the need for legal harmonization to warrant a decision by the Revision court under § 543 Abs. 2 Satz 1 ZPO.
