Inadmissibility of legal appeal against interim injunctive relief and denial of legal aid due to hopeless litigation
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (1st Civil Senate) dismissed the appellant's complaint as inadmissible and denied the application for assignment of counsel, leaving the underlying interlocutory order from the Regional Court of Trier in force. The dispute involved a challenge to an interlocutory injunctive relief (einstweilige Verfügung) where the appellant filed a letter intended as a complaint. The court ruled that a legal appeal (Rechtsbeschwerde) is not statable in proceedings concerning interim injunctions, rendering the complaint procedurally barred and the intended litigation hopeless. The decision is based on the procedural admissibility rules of German civil procedure, specifically the exclusion of appeals in interim relief matters and § 78b Abs. 1 ZPO regarding the refusal of legal aid due to the lack of prospects for success.
