Confiscation of Crime Instruments in Organized Theft: Discretionary Assessment Under § 74(1) StGB
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice partially granted the defendant's revision, specifically ordering that the confiscation of tools used as instruments of the crime be set aside pursuant to § 421(1) No. 2 StPO, while rejecting the remainder of the appeal and upholding the lower court’s overall verdict including the total custodial sentence and the order for confinement in a detoxification facility. The case involved a conviction for serial organized theft where the defendant challenged the procedural and substantive validity of the judgment, which included the seizure of six handbags as illicit gains and various tools (crowbars, hammers, pliers, gloves, levers, and two mobile phones) as instruments of the crime. The decisive legal issue was the failure of the lower court to demonstrate the required discretionary assessment for confiscation under § 74(1) StGB, as the judgment implied a mandatory application of confiscation rather than an exercise of judicial discretion, necessitating the appellate court to exercise its own discretion to waive the seizure for procedural economy.
