Consumer credit directive: Acte clair doctrine precludes suspension of proceedings for preliminary reference
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) dismissed the plaintiff's non-admission complaint and denied the application to suspend proceedings, thereby upholding the lower court's refusal to stay the case. The dispute concerned the consumer credit directive and related leasing contract issues, where the plaintiff argued that pending preliminary reference questions raised by the regional court regarding EU law interpretation necessitated a suspension of proceedings under § 148 ZPO. The BGH held that no suspension was warranted because the legal questions were manifestly clear (*acte clair*) based on the wording, systematics, and purpose of the Consumer Credit Directive, and the matter lacked fundamental significance or a need for uniform jurisprudence development under § 543 (2) Sentence 1 ZPO, with the court relying on its established case law from 2020.

Januar 2020 - VIII ZR 80/18, BGHZ 224, 302 Rn. 51). Von einer weiteren Begründung wird gemäß § 544 Abs. 6 Satz 2 Halbs. 2 ZPO abgesehen.
Der Kläger trägt die Kosten des Beschwerdeverfahrens (§ 97 Abs. 1 ZPO).
Der Gegenstandswert des Beschwerdeverfahrens beträgt bis 30.000 €.
