The German Federal Court of Civil Law (BGH) dismissed the appeals against the refusal to admit an appeal on points of law, thereby leaving the Lower Regional Court’s judgment in force. The dispute concerned the validity of a termination for own use (Eigenbedarf) and the tenant’s subsequent claim for damages, with the tenant challenging the appellate court’s assessment of the landlord’s intent. While the BGH acknowledged that the lower court incompletely articulated the doctrine of abuse of rights—specifically by failing to analyze whether the landlord’s housing need could be met in an alternative available apartment, which is relevant beyond just the obligation to offer the property—it ruled that this error did not meet the threshold for admitting revision under § 543 Abs. 2 ZPO given the specific circumstances of the case. The court ordered the costs of the appeal proceedings to be borne by the parties themselves and set the value of the appeal at €8,986.92.

Volltext

2 ZPO abgesehen.

Die Kosten des Beschwerdeverfahrens werden gegeneinander aufgehoben (§ 97 Abs. 1, § 92 Abs. 1 Satz 2 ZPO).

Der Wert der Beschwerdeverfahrens beträgt 8.986,92 €.
