Withholding of wages and tax evasion: correcting overcounted concurrent offenses without altering sentence
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Criminal Court (BGH) dismissed the defendant's revision as unfounded, upholding the Landgericht Kiel's conviction and sentence while correcting the judgment's operative clause to reflect the commission of 69 offenses of withholding and misappropriation of wages, with 62 cases involving concurrent tax evasion and fraud. The case concerned the defendant's appeal against a lower court verdict for embezzlement of labor remuneration and related tax crimes; the BGH identified a clerical error where the lower court had incorrectly counted an additional instance of concurrent tax evasion in case 10, which did not form the basis of the actual sentence. Relying on § 354 Abs. 1 StPO analog, the appellate court ruled that the exclusion of this erroneously included tax evasion count did not affect the calculated individual sentence, as the sentencing had already rested solely on the confirmed facts of withheld social insurance and SOKA-Bau contributions, thereby leaving the overall penal outcome unchanged.
